If a business wants to sue another party for trade libel, they must prove the other party published a statement that was false, caused injury to the plaintiff, and was not in a privileged category.
  • Commercial disparagement. This is another type of defamation that can happen to business organizations. With trade libel, the plaintiff only has to prove the statement was false, injurious, and not privileged, but with commercial disparagement, they have to prove the defendant knew the statement was false and intentionally published it to harm the plaintiff. Obviously, this is a more difficult burden of proof to meet.
